This Arttion Content License Agreement (“License”) governs the access to and use of all images and related content made available on Arttion (“Arttion”, “we”, “our”, or “us”). By accessing, downloading, or using any Content, you agree to be bound by these terms.

1. Definitions

  • “Content”: All images, image data, previews, metadata, and AI-generated outputs available on Arttion.

  • “User”/“You”: Any individual or entity accessing the Content.

  • “AI-Generated Content”: Images created via Arttion’s proprietary or licensed artificial intelligence systems.

2. Ownership and intellectual property

  • Arttion Ownership: All Content is generated through AI technologies configured and operated by Arttion. To the maximum extent permitted by applicable law, Arttion retains all proprietary rights, including database rights and sui generis rights.

  • Legal Status of AI Works: You acknowledge that the copyrightability of AI-generated content is subject to evolving laws. Arttion grants rights to the extent protectable under applicable law.

  • No Transfer: This License is a grant of use, not a transfer of title.

3. License grant

Subject to your compliance with this License, Arttion grants you a worldwide, non-exclusive, non-transferable, revocable license to:

  • Commercial & Personal Use: Use Content for advertising, marketing, websites, social media, and digital/print publications.

  • Modification: Crop, edit, overlay text, or combine Content with other materials to create derivative works.

  • Digital & Physical: Display Content in digital formats and physical merchandise.

4. Prohibited uses

4.1. Redistribution & Competition:

  • You may not sell, sublicense, or redistribute Content as standalone files (e.g., on stock photo sites like Shutterstock, Adobe Stock, etc.).

  • You may not use Content to create a competing image generation service or dataset.

4.2. Intellectual property abuse:

  • You may not claim authorship or register Content (or direct derivatives) as your own trademark or copyrighted work.

  • You may not remove any invisible watermarks or proprietary metadata embedded in the files.

4.3. AI-specific restrictions:

  • No Model Training: You are strictly prohibited from using Content to train, fine-tune, or improve any machine learning or AI models.

  • Biometrics: You may not use Content for facial recognition or biometric surveillance.

4.4. Ethical & legal limits:

  • No use in defamatory, pornographic, or illegal contexts.

  • No use to create “deepfakes” or disinformation intended to deceive the public.

5. Attribution

Attribution is not mandatory for commercial use. However, if you choose to provide it, please use:

6. Disclaimer of warranties

Content is provided “AS IS”. Arttion makes no guarantees that the Content will meet your requirements or that it does not inadvertently infringe upon third-party rights (such as personality or publicity rights of individuals who may resemble AI-generated faces). You use the Content at your own risk.

7. Limitation of liability

To the maximum extent permitted by law, Arttion shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Content, even if advised of the possibility of such damages.

8. Indemnification

You agree to indemnify, defend, and hold harmless Arttion and its affiliates from any claims, losses, or expenses (including legal fees) arising out of:

  • Your violation of this License.

  • Your use of Content in a way that infringes third-party rights or violates any law.

9. Termination

  • This License terminates automatically if you breach any terms.

  • Upon termination, you must cease all use of the Content and delete all copies in your possession.

10. Severability and governing law

  • Severability: If any provision is found unenforceable, the remaining terms shall remain in full force.
